Terms of Service

These Terms of Service ("Terms") govern your access to and use of Enclave ("the Service"), operated by Wasted My Ult ("we", "us", "our"). By using Enclave, you agree to these Terms.

1. Acceptance of Terms

By creating an account or using the Service, you confirm that you are at least 13 years of age and agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Description of Service

Enclave is a communication platform that allows users to create and join communities ("servers"), send messages, share files, and communicate in real time. We provide the platform infrastructure; we do not create, endorse, or control user-generated content.

3. User Accounts

You are responsible for maintaining the security of your account credentials. You are solely responsible for all activity that occurs under your account. You must notify us immediately of any unauthorized use.

4. User-Generated Content

You retain ownership of content you create and share on Enclave. By posting content, you grant us a limited, non-exclusive license to store, transmit, and display that content solely for the purpose of operating the Service.

You are solely responsible for the content you post. We do not pre-screen, monitor, or endorse user content. We are not liable for any content posted by users of the Service.

5. Prohibited Conduct

You agree not to use the Service to:

Violate any applicable law or regulation
Post content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
Distribute child sexual abuse material (CSAM) or exploit minors in any way
Engage in fraud, phishing, or distribute malware
Infringe on intellectual property rights of others
Harass, stalk, or threaten other users
Attempt to gain unauthorized access to the Service or other users' accounts
Use the Service for any purpose that violates our Acceptable Use Policy

6. Platform Liability & Safe Harbor

Enclave operates as a platform provider, not a publisher. In accordance with Section 230 of the Communications Decency Act (47 U.S.C. § 230) and equivalent international provisions:

We are not liable for content created, posted, or shared by users.
We do not endorse, verify, or guarantee the accuracy of any user-generated content.
Server owners and administrators are responsible for moderating their own communities.
We reserve the right, but have no obligation, to remove content or suspend accounts that violate these Terms.

7. Server Owner Responsibilities

If you create or administer a server on Enclave:

You are responsible for moderating content within your server.
You must establish and enforce community guidelines that comply with these Terms and our Acceptable Use Policy.
You must promptly address reports of prohibited content within your server.
Failure to moderate may result in your server being removed and your account being suspended.

8. Reporting & Takedowns

We provide mechanisms for reporting content that violates these Terms or applicable law. We will respond to valid reports and legal requests in accordance with our obligations. See our DMCA & Takedown Policy for copyright-related claims.

9. Termination

We may suspend or terminate your account at any time, with or without notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties. You may delete your account at any time through your account settings.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

12. Indemnification

You agree to indemnify, defend, and hold harmless Wasted My Ult, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, your content, or your violation of these Terms.

13. Governing Law

These Terms are governed by the laws of New Zealand. Any disputes shall be resolved in the courts of New Zealand.

14. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes via the Service or email. Continued use after changes constitutes acceptance of the updated Terms.
